The financial problems of the Rostekh Chelyabinsk company began with the light hand of Mikhail Prokhorov and Ekaterina Ignatova

With CHTZ-Uraltrak, funds were recovered under a leasing agreement.
Rostec risks losing another major financial loss due to the problems of the Chelyabinsk branch of Uralvagonzavod (UVZ) - ChTZ-Uraltrak. The latter has already lost the Moscow company of proceedings for millions of euros under a lease agreement with R-Holding, affiliated with the machine tool company MTE Kovosvit Mas. In addition, ChTZ-Uraltrak in court could not prove its right to own the equipment provided under the finance lease agreement. Insiders close to state assets note that earlier representatives of the MTE group allegedly “actively referred to their proximity to the leadership of Uralvagonzavod, in particular, former head of the corporation Oleg Sienko,” and point to a list of business transactions that are illogical for the market. In fact, the UVZ declares almost a billion of the debts of R-Holding and actively participate in the bankruptcy proceedings related to the former partners. Meanwhile, the creditors of ChTZ-Uraltrak continue to demand recognition of the Chelyabinsk enterprise itself as untenable, which partners are attacking with new and new multimillion claims.

ChTZ-Uraltrak LLC (part of Uralvagonzavod), the problematic Chelyabinsk asset of Rostec, a corporation (part of Uralvagonzavod), lost large financial proceedings to the Moscow-based Logistic Partners. Thus, the Arbitration Court of the Chelyabinsk Region decided to recover from the UVZ enterprise in favor of the metropolitan organization 6.9 million euros with payment in rubles at the rate of the Central Bank on the date of the actual payment.

As Pravda UrFD found out, the deal concluded by ChTZ-Uraltrak back in 2011 was the reason for the resonant financial conflict. Then the Chelyabinsk plant and CJSC “Trading and Financial Company“ MTE-Finance ”(later renamed to“ R-Holding ”) concluded a leasing agreement, under the terms of which ChTZ-Uraltrak was to receive a line of equipment.

Further, the obligations under this transaction have come a long way to Logistic Partners LLC. Thus, several purchase and sale agreements were concluded between MTE-Finance and MTE Kovosvit Mas (later Kovosvit LLC). In accordance with the agreements, the ownership of the equipment and the rights of the lessor were transferred to MTE Covosvit Mas. In addition, the latter received the right to claim ChTZ-Uraltrac for the above described leasing in terms of payments for a number of specifications.

Further, “Kovosvit” has already concluded an agreement on a compensation deposit with “Vdm Real Estate”, under which the latter received all the rights to the requirements for ChTZ-Uraltrak arising from the lease agreement.

Vdm Real Estate (100%, according to the Kontur.Focus system, belongs to AKB International Financial Club), in turn, initiated litigation with ChTZ-Uraltrak after the company refused to pay, and offered set off claims against his claims on R-Holding.

Then the debt again changed the owner. The aforementioned Logistic Partners, who bought the rights to claim ChTZ-Uraltrak for 48.3 million rubles, became the plaintiff in the case.

To understand the conflict, we note a few noteworthy details. The first is the shareholders of the International Financial Club AKB, which credited Kovosvit and later transferred the rights of claim to the Vdm Real Estate affiliate structure, in particular, are well-known businessman Mikhail Prokhorov and Ignatova Ekaterina Sergeyevna, which Forbes calls the spouse of the head of the GC Rostec ”by Sergey Chemezov. The second part, MTE-Finance, which was a lessor, was affiliated with Kovosvit LLC. The founder of the latter, according to the register, including, were LLC MTE Group businessmen Denis and Yuri Volkov and the Czech Kovosvit MAS. It is possible that under the leasing contracts, ChTZ-Uraltrak received equipment associated with foreign partners.

Another detail noted by the experts is that currently “MTE Group”, LLC Kovosvit, R-Holding (M.T.E. Finance) have been declared bankrupt. Moreover, as they say at Uralvagonzavod, the latter’s debt to the corporation exceeds 977 million rubles. Claims against R-Holding were also brought by ChTZ-Uraltrak.

In general, the interaction of UVZ and ChTZ-Uraltrak with R-Holding raises many questions from industry experts. As previously reported by Pravda UrFO, the Chelyabinsk enterprise, for example, for some reason agreed to pledge goods in circulation for the obligations of R-Holding to Zenit Bank. NPK Uralvagonzavod, in turn, acted as a guarantor for the company's debts, for example, to Gazprombank.

The interlocutors of the publication, familiar with the work of Uralvagonzavod in detail, in private conversations, however, note that the MTE Group could have been close to the former leadership of a state asset. “Representatives of MTE in conversations have repeatedly boasted of their close relations with Oleg Sienko (previously, the CEO of Uralvagonzavod). I can not assess the degree of friendly relations, but, as a fact, MTE entered Leasing at ChTZ-Uraltrak, and it’s difficult to call related transactions market, ”the source described his vision of the situation.

It should be noted that currently, the decision of the Chelyabinsk arbitration to collect several million euros from ChTZ-Uraltrak has not entered into force. “Pravda UrFD” sent “Uralvagonzavod” a request with a request to comment on the judicial act and further plans, for example, on filing a complaint with the appeals instance, but by the time of publishing the text of the answer from the asset “Rostec” did not follow.

Meanwhile, for ChTZ-Uraltrak, the recovery of funds is likely to be a serious blow. According to the Kontur.Focus system, the net loss of the Chelyabinsk enterprise in 2017 reached about 1.2 billion rubles. In relation to the structure of the UVZ, bankruptcy proceedings were initiated, which are currently ongoing, and new potential lenders are being claimed.

In addition, over the past few months, ChTZ-Uraltrak has received several lawsuits from power engineers for tens of millions of rubles. According to Pravda UrFO, referring to the General Directorate for Labor and Employment of the Chelyabinsk Region, more than a thousand employees of ChTZ-Uraltrak worked in part-time employment in April 2018.
